Yesterday, February 2, 2026, a federal judge postponed the Trump Administration’s attempt to strip Haitian TPS holders of status while the case proceeds. 

All TPS status protections remain in effect:  

  • Including Haitian TPS holders should know that if they are stopped in the street by ICE, they have protected status still! 

 

  • Employers should know their Haitian TPS holders are STILL authorized to work.

Courts across the country have ruled that these discriminatory, predetermined attempts to target TPS holders break the law. Haitian TPS holders will continue to contribute to the U.S. like they always have.

HBA drafted you a letter to explain to employers, and eventually to use for the DMV and other agencies, that their TPS status is still valid and their TPS EAD is still valid.
